Life shouldn’t be complicated so we’ve kept our Terms & Conditions as simple and clear as possible.
Once you have paid your Deposit with Always Windy you are bound by these Terms and Conditions.
It is important at this stage to ensure that you let us know of any discrepancies with the confirmed booking details. It is your responsibility to ensure all these details are correct and advise us immediately should there be any discrepancy.
When all or part of the reservation is made via an intermediary (i.e. Planet Kitesurf Holidays) the liability of Always Windy will be entirely limited to the scope of these Terms & Conditions.

Terms & Conditions

Changes in Price

We reserve the right to increase the price after booking if any increase in price occurs in respect of adverse changes to currency exchange rates.

Deposits, Payments & Cancellations

Always Windy will require a deposit to secure your booking with full payment to be made on arrival. All prices and availability are subject to change until we have received the appropriate cleared funds from all parties.

The deposit amount will vary depending on the combination of activities and accommodation booked.

You will receive a Booking Confirmation with full details of your booking, deposit and final payment details.

Non-receipt of your Deposit payment, by the stated due date, will result in your booking being cancelled.

All deposits are non-refundable

There may be some occasions where all fully pre-paid Instructional hours are not used. A ‘Voucher’ will be offered, at the discretion of the school, for any Instructional hour(s) not completed ONLY if agreed at the time of your holiday that the weather conditions were unsuitable. Always Windy does not offer cash refunds but a ‘Voucher’, issued by the school, may be used against like for like services for up to a 1 year period

Accommodation Cancellation

If for any reason you have to cancel your trip the Cancellation Policy of the accommodation you have booked with will come into effect. Before cancelling your trip please contact us for full a Cancellation Policy.

Limitation of Liability/Disclaimer/Force Majeure

Compensation or refund payments will not be made for changes that arise as a result of situations outside of our control, for example, cancellation of airline flights. When we refer to circumstances beyond our control, we mean any event that we, or the supplier in question, could not foresee or avoid, even after taking all reasonable care.
Such circumstances of Force Majeure will usually include, but are not limited to: war or threat of war, riots, terrorist activity, civil strife, strikes and other industrial disruption, technical problems with transport including changes imposed due to rescheduling or cancellation of flights by an airline or main charterer or alteration of the airline or aircraft type for reasons beyond our control or that of our suppliers; closed or congested airports or ports, natural or nuclear disasters, fire, quarantine, epidemics, health risks, actual or threatened severe weather conditions, Government action, change to Foreign Office advice to advise against travel to your destination, significant building work on-going outside of your accommodation (such as resort development) or other events beyond our control.
Very rarely, due to a situation of Force Majeure, we may have to change or terminate your arrangements after departure. If this situation does occur, we regret we will be unable to make any refunds, pay you compensation or meet any costs or expenses you incur as a result.

Breakdowns/Complaints

In case of breakdowns in, or complaints about, the property in which you are staying, or any other aspect of your holiday you should notify us locally immediately, in order that problems can be resolved, where possible, during your holiday and to mitigate any losses, expenses or costs you may incur. You should retain a record of your complaint and details. Once we, and the supplier concerned, are aware of the problem everything reasonably possible will be done to resolve it as quickly as possible.
It is unreasonable to take no action whilst on holiday but then to write a letter of complaint upon your return. We regret we cannot accept liability in relation to any complaint which is not brought to our attention entirely in accordance with this clause.

Pre-Booked Sports Services

In the course of your booking you may decide to pre-book some kitesurfing tuition and/or equipment hire. It is important to pre-book services to guarantee availability of equipment and instructors.
In some locations Always Windy use experienced and trusted partners for instruction.

When in Turkey: Beginner courses advertised on this site are for group lessons, however should our partner not have enough students to make up a group session, the Beginner course will default to a Private lesson and will therefore be reduced hours but one-to-one tuition, rather than the 9 hours group session booked. In this instance there will be no change in the price or the content of the course. Any further hours tuition required, above the reduced hours, will be charged at the local partner’s rate and will be discussed and agreed upon before continuing.

Transfers

Always Windy shall not be liable for any loss, delay or costs connected with and arising out of adverse weather or traffic conditions including blocked roads. In the event that you should be delayed and are not able to arrive at your hotel or destination or miss your return flight due to adverse conditions such as blocked roads or closed resorts we will endeavour to organise a suitable alternative, however any additional costs will have to be borne by you as every passenger is assumed to have adequate travel insurance including ‘missed departure’.

Always Windy cannot and therefore do not guarantee wind at any of their destinations, however we will do our best to only be in locations where the conditions are fantastic!

Always Windy cannot be held liable should any of our partners not have the required local paperwork to operate, or inadequate insurances.

General Information

Passports & Visas

European nationals must hold a full 10-year passport, with at least 6 months validity remaining at the point of return, for entry into most countries.

Visas are your responsibility prior to or on entry to a country but we are more than happy to give advice when asked. Nationals of other countries must check with the appropriate consular authorities.

Insurance

It is STRONGLY advised that you have full holiday insurance in place before departure. Please ensure that your insurance covers you for any sporting activities in which you will be participating.
Always Windy cannot cover its clients for Public Liability when free riding and therefore highly recommend that you take out individual insurance before arrival.

Data Protection

We do not pass on any of your details to anyone but will add you to our mailing list. If you do not wish to receive our Newsletters, please let us know but you will be missing out!

Intellectual Property Rights

Always Windy is the owner or the licensee of all intellectual property rights on our Website and of the material published on it.
The content of this site therefore cannot be used in any form without prior authorisation.
